BouncingDiary Marketing Agency - Terms and Conditions

These Terms and Conditions ("Agreement") are entered into by and between BouncingDiary Marketing Agency ("BouncingDiary," "we," or "us") and the entity or individual ("Client" or "you") engaging BouncingDiary's marketing services. By agreeing with BouncingDiary, you agree to be bound by the following terms and conditions:

1. Services

1.1 BouncingDiary agrees to provide marketing services ("Services") as outlined in the signed agreement or proposal. This may include but is not limited to:

  • Social Media Management

  • Content Creation

  • Email Marketing

  • Sales services

  • courses & Coaching

  • Website Development

1.2 The specific details of the Services, including timelines, deliverables, and fees, will be outlined in the agreement signed by both parties.

2. Client Cooperation

2.1 Client agrees to provide timely and necessary information, materials, and approvals required for BouncingDiary to perform the Services effectively.

2.2 Client acknowledges that any delays caused by the Client in providing necessary materials or approvals may result in a delay in the delivery of Services, and BouncingDiary will not be held responsible for such delays.

3. Fees and Payment

3.1 The Client agrees to pay BouncingDiary the fees as outlined in the agreement. Fees may include:

  • subscription on set days per month

  • Monthly retainer fees

  • Additional expenses (IF REQUIRED advertising costs, stock images, etc.)

  • One-off castle booking deposits at 15%

3.2 Payment terms and schedule will be outlined in the agreement. Failure to make timely payments may result in suspension of Services until payment is received.

If the sum of the subscription amount isn't booked into your diary that month there will be no payment required for the following month- If we fail to gain new bookings the following month we will refund your original subscription in FULL within 30 days- All subscription payments must be made in advance of us advertising your services

4. Term and Termination

4.1 The term of this Agreement shall begin on the effective date and continue until the Services are completed, or either party provides written notice of termination if non-subscription this will be ongoing until either party chooses to terminate

BouncingDiary can terminate a subscription for any reason at any time

5. Confidentiality

5.1 Both parties agree to keep confidential any information disclosed during the course of the Services.

5.2 BouncingDiary may use the Client's name and logo in marketing materials unless otherwise agreed upon in writing.

6. Intellectual Property

6.1 Client acknowledges that all intellectual property developed or used by BouncingDiary in connection with the Services shall remain the property of BouncingDiary.

6.2 BouncingDiary grants Client a non-exclusive, non-transferable license to use any deliverables created during the term of this Agreement solely for Client's business purposes.

7. Limitation of Liability

7.1 BouncingDiary shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with this Agreement.

7.2 BouncingDiary's total liability under this Agreement shall not exceed the total fees paid by Client to BouncingDiary.

All castles hired are at the customer's (your) liability, BouncingDiary is only responsible for the admin on the booking service

9. Entire Agreement

9.1 This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.

By signing this Agreement, both parties acknowledge that they have read, understood, and agree to all the terms and conditions outlined herein.
